Critics of Monsanto claim that the

company has been able to ignore the human and environmental damage caused by its products and pursue it devastating activities through a systematic concealment strategy through lobbying. regulators and government authorities, lying, corruption, commissioning bogus scientific studies, putting pressure on independent scientists, and manipulating the press.

Our endeavor is based on the observation that only through civic action will we be able to achieve compensation for victims of the American multinational. The procedures are a veritable obstacle course for the victims. They are reluctant to invest time and money in litigation, especially since there is no reason to believe in a positive outcome. Frequently, when a company like Monsanto is the defendant, the company settles out of court, whereby circumventing the establishment of a negative legal precedent.

Currently, it is impossible under law to bring criminal charges against a company like Monsanto or its management, for their crimes against human health and the integrity of the environment.

Each year, Monsanto spends enormous amounts on legal defense to fend off the cases brought by the victims of its activities. This does not encourage the company to change its practices. So long as it remains more profitable for shareholders to take risks in the community – even if that means compensating the victims occasionally – these practices will persist.

Monsanto’s history is a paradigm for the impunity of transnational corporations and their management, who contribute to climate change and the depletion of the biosphere and threaten the security of the planet.

Monsanto is not the only focus of our efforts. Monsanto will serve as an example for the entire agro-industrial system whereby putting on trial all multinationals and companies that employ entrepreneurial behavior that ignore the damage wrecked on health and the environment by their actions.


General purpose of the Tribunal:

To get a ruling – even symbolic – against Monsanto by a bench of real judges, after
veritable proceedings in an international court, and contribute to the establishment of international mechanisms to bring justice to victims of multinationals.

Specific objectives:
• Assess the case against Monsanto and the damages caused pursuant to international law;
• Assess Monsanto’s actions in relation to the crime of ecocide. Citizens’ movements have made an appeal for international criminal law to recognize this as a crime;
• Consider a possible amendment of the Rome Statute establishing the International
• Criminal Court to include the crime of ecocide, making it possible to try natural and legal persons for this crime.

Expected Results/Impact of the Tribunal:

Public opinion and policy makers will gain heightened understanding of Monsanto’s
practices and their impact on the environment and human rights. The Tribunal will raise awareness of the dangers of industrial and chemical agriculture and the need a shift in agricultural paradigm.


The Tribunal will contribute to the ongoing debate on what it means to hold a company responsible for violating fundamental rights including but not limited to the right to food, health, information etc.

The Tribunal’s work will give victims and their legal counsel the arguments and legal grounds for further lawsuits against Monsanto within their national jurisdictions.

The Tribunal will highlight the need to change international law so that victims of
transnational companies have a means to legal redress.

The Tribunal will show, through the example of Monsanto, why the crime of ecocide must be recognized under international law.

How the Tribunal will Function:

  • The Tribunal will employ as its legal guidelines: the UN Guiding Principles on Business and Human Rights, adopted by the Council of the UN Human Rights June 2011; the Rome Statute establishing the International Criminal Court (ICC) giving it jurisdiction to try alleged perpetrators of genocide, crimes against humanity, war crimes and crimes of aggression.

The UN Guiding Principles on Business and Human Rights is the international authority on the responsibilities of business with regard to human rights. The guidelines state that companies must respect all human rights, including the right to life, the right to health and the right to a healthy environment. They define society’s expectations vis-à-vis businesses. They will serve as the basis on which plaintiffs will build their case for demanding compensation from Monsanto for damage caused by the company’s activities. The Court will consider whether Monsanto’s conduct could be considered criminal pursuant to existing international criminal law, or under the law of ecocide, which is gaining support for consideration as an offence.

  • Prior to the event, working groups will study the impact of Monsanto’s activities in the following 6 areas:
    • Right to a healthy environment
    • Right to health
    • Right to Food
    • Freedom of expression and academic research
    • Complicity in warcrimes
    • Crime of ecocide

The Terms of Reference are as follows:

Question 1: Did the firm Monsanto violate, by its activities, the right to a a safe, clean, healthy and sustainable environment, as recognized in international human rights law (Res. 25/21 of the Human Rights Council, of 15 April 2014), taking into account the responsibilities imposed on corporations by the Guiding Principles on Business and Human Rights, as endorsed by the Human Rights Council in Resolution 17/4 of 16 June 2011?

Question 2: Did the firm Monsanto violate, by its activities, the right to food, as recognized in Article 11 of the International Covenant on Economic, Social and Cultural Rights, in Articles 24.2(c) and (e) and 27.3 of the Convention on the Rights of the Child, and in Articles 25(f) and 28.1 of the Convention on the Elimination of All Forms of Discrimination against Women, taking into account the responsibilities imposed on corporations by the Guiding Principles on Business and Human Rights, as endorsed by the Human Rights Council in Resolution 17/4 of 16 June 2011?

Question 3: Did the firm Monsanto violate, by its activities, the right to the highest attainable standard of health, as recognized in Article 12 of the International Covenant on Economic, Social and Cultural Rights, or the right of child to the enjoyment of the highest attainable standard of health, as recognized by Article 24 of the Convention on the Rights of the Child, taking into account the responsibilities imposed on corporations by the Guiding Principles on Business and Human Rights, as endorsed by the Human Rights Council in Resolution 17/4 of 16 June 2011?

Question 4: Did the firm Monsanto violate the freedom indispensable for scientific research, as guaranteed by Article 15(3) of the International Covenant on Economic, Social and Cultural Rights, as well as the freedoms of thought and expression guaranteed in Article 19 of the International Covenant on Civil and Political Rights, taking into account the responsibilities imposed on corporations by the Guiding Principles on Business and Human Rights, as endorsed by the Human Rights Council in Resolution 17/4 of 16 June 2011?

Question 5: Is the firm Monsanto complicit in the commission of a war crime, as defined in Article 8(2) of the Statute of the International Criminal Court, by providing materials to the United States Army in the context of operation “Ranch Hand” launched in Viet Nam in 1962?


Question 6: Could the past and present activities of Monsanto constitute a crime of ecocide, understood as causing serious damage or destroying the environment, so as to significantly and durably alter the global commons or ecosystem services upon which certain human groups rely?

  • The Monsanto Tribunal will collect testimonies and an important information
    gathering effort will be made. Olivier De Schutter, law professor at the University of Louvain, will, with the assistance of forty law students, review the records of all the victims and identify the charges. They will prepare legal briefs that the plaintiffs and their legal representation can use in their arguments.

  • Illustrious lawyers and judges from five continents will be involved in the Tribunal’s work. The court will have two co-presidents.
  • The Monsanto Tribunal will hear the cases of 20 plaintiffs from the South and North Americas, Europe, Asia and Africa. The plaintiffs will have experienced counsel to represent them.

  • The Tribunal will comply with the general principles of law of civil procedure.
    Monsanto will be invited to make submissions. Monsanto – as a defendant – will be heard in response to allegations, to defend the legality of its acts, and to challenge the claims of alleged victims.

  • As with the International Court of Justice, the President will receive all documents. Lawyers will prepare and submit their findings to the judges. They will also appear before the judges to plead their case. Victims (or anyone in the audience) may submit documents to the judges and plaintiffs will speak at the hearing. The judges will deliberate and will hand down a decision – based on the evidence – on the 6 questions.


  • The court hands down its decision in December 2016.

Expertise Opinions to the service of the Tribunal:

Mart-museumembers of civil society from different professional backgrounds who all have expertise in relation to the subjects and issues to be addressed by the Tribunal Monsanto took the initiative to organize the Tribunal. This group has rallied representatives of civil society with relevant expertise to the effort. They form the Monsanto Tribunal organizing committee, essentially all volunteers who are willing to provide their expertise for this project. (A list of the members of the organizing committee can be found in the appendix).

Students from the following universities will also bring their expertise to the endeavor by taking part in the research and case review phase:
• University of Louvain (Belgium)
• Yale University (United States)
• University of Bordeaux (France)

Civil Society Organizations from five continents will contribute to vetting judges, lawyers, plaintiffs and witnesses.

They will be invited to participate in outreach and awareness raising activities in their respective countries and citizen mobilization.

They will be active in organizing the People’s Assembly, which will be organized as a side event to the Monsanto Tribunal.

As I watch the breaking news of mandatory evacuations where friends of mine live while I’m bracing for what is billed as the first of what we hope will be many wet winter storms , I’m reminded life goes on.
Life goes on. People always say it. We know about evolution and how to adapt. In times of reflection you have to wonder how has the homo sapiens clever little brain become so disconnected from their heart when it come to compassion and understanding for their fellow man? But Life Goes On.
Of course I will be speaking today on the GMO issue in our food supply. As the Monsanto Tribunal begins, Monsanto makes an apologetic statement about how they will not attend a peoples public court of moral opinion. Yeah…you know me gotta go there. Ok Monsanto…Would you participate if it was a court of “immoral” opinion??? How about with purchased commentators, or with purchased elected officials. I say this as I personally have never spoken to an unpaid “pro-GMOer”. Make no mistake here, the powers to be understand Life Goes On.

Or how about an event with your very own pseudo-scientists. We can even go further and use your very own medical hucksters for quackery medical opinions? To quote a Forbes contributor and freelance writer Kavin Senapathy. Now you may be asking yourself who this person might be I find so fascinating today. Kavin Senapathy is a science communicator, author and mother of two based in Madison, Wisconsin. You can follow her on Facebook a social media site that routinely practices censorship of negative Monsanto articles  and Twitter.

Let’s be clear. Adopting a court’s guidelines is nothing more than thinly-veiled melodrama. The tribunal is not governed by the United Nations nor by the International Criminal Court, an international treaty-based court not affiliated with the UN. Using the guidelines of both for their trial, the Monsanto Tribunal grasps for authenticity for a glorified meeting of the who’s who of anti-biotech science deniers, during which they will undoubtedly find the absent defendant guilty…

Make no mistake this bright and up coming young lady has a tremendous amount to lose should what many perceive as the truths about the GMO products are believed by…oh gosh any court. I’m not quite sure how this young aspiring freelance writer is qualified to comment in the manner she has. If you’re wondering what a “science communicator” is??? Don’t feel bad I also had to look it up…

Science communication generally refers to public communication presenting science-related topics to non-experts. This often involves professional scientists (called “outreach” or “popularization”), but has also evolved into aprofessional field in its own right. It includes science exhibitions, journalism,policy or media production.

Amazing how folks can be duped and used. Of course today I have to hold my hand up as I also have decided to use the young lady for my selfish purposes. I mean I don’t very often get the opportunity to write about a drop dead gorgeous bright inelegant young lady that devoted a good deal of time from oh so young life to writing a book specifically to discredit another drop dead gorgeous bright intelligent young lady. The subject matter, our food supply.
As a matter of fact I can not recall a time in my life where someone decided this person is a bold face liar and I’m going to write a book discrediting them. Awwwww Life Goes on.

I chose this person to show how crafty the Monsanto Propaganda Machine can be. This young lady has come across as an authority on the issues, trashes a lot of knowledgeable people in their respective fields.
I found an interview Kavin did in a publication called Good, a new media outlet with a deceptive name, here is an exerpt.

You are marching against a march against Monsanto. Does that mean you are pro-Monsanto?
No. If anything, it’s a Monsanto-neutral march. We aren’t pro- or anti-Monsanto at all. We’re just trying to spark discussions about scientific myths, and to correct misinformation.
Are you looking to engage in direct dialogue with the opposition?
The reason we go to this march isn’t necessarily to engage participants themselves. I mean, we empathize and have compassion for these people. Most of them have legitimate health concerns for themselves and their families. But many of them are pretty far down the rabbit hole. There are anti-vax people, people who believe in chemtrails, they even just posted something on their web page from a moon landing denier. We’re more interested in raising general public awareness that there are two sides to the (GMO) issue.
What is the harm in GMO misconceptions?
They influence public perception, which in turn influences policy. This keeps consumers from getting Golden Rice and other nutrient-fortified crops, and puts a damper on innovating new products. I would love to see smaller agriculture companies and farmers competing in this arena so we could have things like tear-free onions and non-browning avocados. Regulations are so stringent, though, it’s very difficult to get these things from research to market.

Now pardon me but how is a “science commentator” become qualified to make statements like that? The article of May 20 2016 speaks of “Golden Rice” another failed product the Agrochemical Giants have produced stuffed down the poor and starving peoples throats. Its obvious that Kevin has no clue about the products she is touting. “tearless onions” sorry but that just doesn’t appeal to me…but then I don’t depend on a box of prepared processed food to eat. I actually know how to cook food in a pot or frying pan I’m not so concerned with time being limited in my busy life that a microwave is a necessity in life. In guessing Kavin  in her quest to bamboozle everyone into thinking she is doing all this anti-anti-GMO people stuff out if the kindness of her heart???? So if it were up to Kavin there would be no regulations governing our food supply. I have to wonder if the good mother of two feeds those children food that contains azodicarbonamide??? An ingredient that Vani Hari reported on .

Oh that Golden Rice. Let me ask you something folks. Do you want to go to a buffet and eat food that could possibly have been sitting for 36…48 hours? That is what COULD happen. Think about the apples or avocados that won’t brown. We are not speaking about producing “ healthier food” or to use the phrase of the deceptive Big 6 Ag, “More Nutritious” food. No these luxuries in food if you will are for profit not our health. Not our well being, profit. But Life Goes On.
Now I have not personally met Vani Hari nor Kavin, while I respect both of these young ladies I was seriously puzzled that someone would write a book specifically to discredit a person. I inquired about why one would spend a ton of time and energy to discredit a “cutesy airhead TV personality”? Here’s the question and her reply…
Why would you spend the amount of time required write a book that is written to specifically discredit one person???

Seriously…the gal is cute and all but I can find absolutely no value personally… My next comment may surprise you…in discrediting a cutesy airhead TV food personality unless someone offered me a but load of money…
You’re a sharp gal why on earth would you devalue your time doing that????
….Finally, this isn’t a “gal” v. “gal” thing. I’ll tell you I’m as leftie/liberal as they come, my fight is primarily for social justice.

Seriously???? Ok how about Zen Honeycutt??  Social Justice??? But not one word about the lies Monsanto and Big Ag companies have been telling about their products for the past 20 plus years???
I will let you decide whom pays this young lady. Is it possible that Monsanto has taken a page from ISIS and Kavin has been recruited to be a subservient sleeper agroterrorist???? With her sole mission to discredit people speaking the truth??? Aweee but Life Goes On.
Not real sure how discrediting a Food TV personality. A TV personality that carved her niche out when she RESEARCHED what is in the food she buys. You see folks Vani Hari reports on what she finds in foods on the shelves in the supermarkets and provides said information to the public. I believe that is just a schouch closer to addressing “social injustice” than writing a book to discredit one. In addition to attacking peoples education and position. I believe one of the issues in what has to be as decisive an issue as abortion is, the fact that people that have chosen the dark side such as Kavin has always say something like this…

Though OCA’s name suggests that it’s a consumer advocacy group, in reality it is one of the most vocal and well-funded opponents of modern agricultural technologies, with a primary goal of ushering in “a global moratorium on genetically engineered foods and crops.”

I have yet to hear anyone say the technology had to go. Not Ronnie Cummins, Vani Hari, not Stephine Senef, Joe Mercola, Vandana Shiva. None of these people have ever stated they are against the technology. This is something that Kavin and the Monsanto Propaganda Machine have concocted.
I like the afore mentioned take issue with the methodology the technology is being used. With the deception that those that own the technology use to implement said technology unchecked into our food supply. The deception in which is displayed on the technology. I don’t buy for one minute the technology is proprietary information. Its science after all and Life Goes On.
As more research is being conducted and the horrifying results get presented, we’ll have to wait and see if those on the side of the money or those on the side of Social Justice prevail. Will the corporations take over politics? Will the pseudo journalists continue to be purchased and propped up? Will Hunger Games come to fruition? Regardless, Life Goes On.
Again, just me, if I was a mother of two I would be far more concerned with what I was putting  on the table for them to eat than writing a book discrediting someone that is providing that information. I would be far more concerned that the company I am going to bat for tell the truth about their products. I would be far more concerned that before I go out of my way to slam someone for asking for food to be properly labeled I truly understood the scientific myths I speak of. Especially when I’m being paid. I guess knowing what you speak on and being provided fodder to write about are two entirely different animals.
I’m not real sure how anyone can support deception, especially when said deception will have a direct affect on their children. That makes absolutely no sense to endanger your child and tell yourself it’s all for Social Justice.
But then that is just me. That is just me wondering how you teach a child about honesty and integrity when you sell your sole to spread drivel about social justice in regards to products that have been lied about by the manufacturers for the past 20 years. Yes life goes on.
